On April 30, USCIS had received enough H-1B petitions requesting exemptions from the fiscal year 2008 (FY 2008) H-1B cap for “foreign workers who have earned a master’s degree or higher from a U.S. institution of higher education” to meet the congressionally mandated exemption limit of 20,000. Cases received on April 30 will be entered to a computer generated random selection process to determine which cases can obtain the caps. On May 8, 2007, USCIS announced that the random selection process has been conducted. Cases which are not selected in the process will be rejected and the filing fees will be returned. If your case reached to the USCIS on April 30, please keep a close eye on it. You should receive either a receipt or a reject notice from USCIS.
