Lay off and Resign

    my previous company had lay off this year. I got a notice from company I can only stay at the company 2month more. it was almost 2 months ago. and Thank God I was able to find other job and I was able to filing to transfer my H-1 visa to new company. I gave a notice to my old company I’m leaving now, but I wanted to make sure my imployment have to be end the time when they said I have to leave. not the day I gave them a notice. because I still need more time for my visa transfer to new company. when I talked about it, HR person asked to me give a resign letter. and I was wondered why do I have to do that? my old company gave me a letter when they noticed me the termination about my employment will end 2months later.
    Sorry about explaining too long. My question is that what is the different about lay off and resign. What will be better for me for my future reference? or benefits in working in US?

      I think resignation is much better than getting layed off.
      They gave you the terminationn letter before hand saying they’ll let
      you go two months later and since you’ve found yourself a new job, why
      don’t you just resign? Resignation is always better than getting layed
      off.

      Why do need time for H1 transfer?
      Haven’t you filed H1 transfer yet?
      As long as you filed your H1 transfer and got the receipt,
      you can start working for the new employer.

      lay off 경우에는 그에 따른 package가 있지 않나요? 예를 들면 근속년에 따라 몇주씩 월급을 준다던지.. 자진 퇴사를 하면 그혜택이 없어질수 있을것 같은데요

      Resignment is much better than lay off for your future reference. Even though luckily you found a new company, lay-off is not a good history for your future.
