On March 9th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Fellow in the Field of Biomedical Sciences (Approval Notice).

    General Field: Biomedical Sciences

Position at the Time of Case Filing: Fellow

    Country of Origin: The Netherlands

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Massachusetts

Approval Notice Date: March 9th, 2016

Processing Time: 6 Days (Premium Processing Requested)

    Case Summary:

A gifted fellow from the Netherlands selected North America Immigration Law Group (WeGreened.com) to help her attain permanent residency. Our client’s advanced degrees and extensive experience in the field of biomedical sciences have shaped her into the leading researcher that she is today, making her a suitable candidate for EB-1A (Alien of Extraordinary Ability).

    EB1A Presentation:

Our comprehensive EB1A petition packet was comprised of data on our client’s 4 publications, the 172 citations to her work, and the 6 instances she conducted peer reviews for 2 scientific journals. We also encouraged our client to touch base with other influential researchers in her field and request for recommendation letters. She did not disappoint, and managed to gather six testimonials that confirmed the importance of her research on neurological diseases. Using these letters and the myriad of information we had gathered, we demonstrated to the USCIS that our client’s investigations significantly impact the United States medical system as well as various other scientific fields aside from her own. According to one of her recommenders (a distinguished professor at one of the country’s top universities): “The fact that [Client’s] work is applicable in so many fields has made her scientific discoveries important and influential around the world and distinguished her among her peers as a researcher at the top of her field, whose absence in the scientific community of biomedical researchers in the United States would be detrimental to further progress.”

    Premium Processing:

Like many of our EB-1 clients, this fellow opted to file her case under Premium Processing (PP) as it allowed her to shorten the overall time spent waiting for the USCIS to make a decision. In this case, she received an approval notice within 6 days (it takes the USCIS between 4-9 months to take action on I-140 petitions filed under regular processing). Although it costs $1,225 more, PP is a good option for petitioners who are reluctant to wait several months for the USCIS to deal with their case.

    Final Step:

Our client chose to file her I-485 application using our D.I.Y. Packet (only available to clients who retained us for their I-140 petition). This packet contains clear instructions on how to file an I-485 application. We wish our client the best with this, and we look forward to receiving an update from her regarding her application.
