Case: Referred Client’s EB-1(a) I-140 Approved within One Day

    In May 2007, we helped a client, Dr. Gupta, successfully get his EB-1(a) I-140 petition approved within one day after USCIS received his case. Dr. Gupta owned a Ph.D. in Electrical Engineering, but he didn’t have any journal publications when he contacted us regarding his case.     Wednesday, May 16

    08:00AM: Dr. Gupta, one of our clients, emailed Attorney Zhang that he had referred our firm to his colleague Dr. Park, and Dr. Park would contact Attorney Zhang for a free evaluation of his I-140 application.

    08:59AM: Attorney Zhang (jzhang@hooyou.com ) received the inquiry email from Dr. Park, who was then in OPT status. His OPT would expire on September 30, 2007.

    09:25AM: Attorney Zhang replied the emailed after he carefully reviewed the CV of Dr. Park. In the email, Attorney Zhang stated the following points:
    1. Dr. Park may apply for an EB-1(a) petition
    2. Dr. Park needs 6 recommendation letters to support his petition;
    3. The premium processing service is a good option for Dr. Park to speed up the processing;
    4. If Dr. Park retains us, we will file his case within one week after all the documents are ready.

    Based on his more than ten years of experience handling EB-1 and NIW immigration petitions, Attorney Zhang believed that Dr. Park may meet the EB-1(a) criterions based on the following facts:

    • Dr. Park had made original scientific contributions of major significance as he had brought innovative solutions to a very challenging issue in his field;
    • He had authored peer-reviewed scholarly articles in the journal of his field;
    • He had reviewed the work of others in his research field.

    10:27AM: Dr. Park replied the email quickly. He said that he could get as many as 8 recommendation letters. However, the letters were prepared for his O-1 petition, which was then being prepared by the attorney of his company. Dr. Park wondered whether those recommendation letters could be used in the EB-1(a) petition.

    10:30AM: Attorney Zhang emailed to Dr. Park that he would review the prepared recommendation letters and gave Dr. Park a phone call as soon as he traveled back to Houston. He was then in New York City. Attorney Zhang made an appointment for himself in our online customer relationship management system (CRM).

    12:35PM: Dr. Park sent Attorney Zhang 8 recommendation letters via email. He thanked Attorney Zhang’s quick response and looked forward to Attorney Zhang’s phone call.

    01:30PM: Attorney Zhang called Dr. Park while he was at NY JFK Airport and discussed the case with him. Attorney Zhang confirmed that the recommendation letters prepared for his O-1 petition were OK for the EB-1(a) petition.

    02:00PM: Attorney Zhang followed the phone conversation with an email. He listed all the services we offered in the email, as well as the link of the Client-Attorney EB-1(a) petition contract in our website.

    08:12PM: Dr. Park raised another concern in an email. He wondered whether he could file his EB-1(a) petition if his employer applied O-1 for him.

    09:13PM: Attorney Zhang confirmed that was OK in an email.

    07:48AM: Dr. Park informed Attorney Zhang that he had signed the contract and the check. All the documents had been mailed out and would be delivered to our office within one day.
    In the email, Dr. Park also asked that whether he should file his I-140 and I-485 petitions concurrently or separately.

    07:40AM: Attorney Zhang suggested he file I-140 petition first through Premium Processing. As USCIS processes petitions with premium service request within 15 days, he could file the I-485 petition later soon.

    09:00AM: Our Houston office received Dr Park’s check and contract.
    10:00AM: Hongmin Zhang, our CRM system administrator converted Dr. Park’s case from “potential case” to “case” in our CRM system.
    10:03AM: Assistant Nosheen emailed the I-140 questionnaire to Dr. Park.

    09:00AM: Dr. Park mailed back the filled questionnaire to Nosheen.
    09:05AM: Nosheen forwarded the questionnaire to Assistant Huamei Qiu for her to prepare the I-140 form.
    04:00AM: Huamei Qiu finished the forms on the same day and emailed it back to Nosheen for use.
    04:30AM: Nosheen emailed the form to Dr. Park for review and signature.

    10:16AM: Dr. Park mailed to Nosheen all the supporting documents, including the recommendation letters, the forms, the degree certifications and other materials.

    04:30PM: Nosheen finalized the preparation of documents of the petition.

    08:31AM: Within one day after USCIS received the petition, an approval e-notice regarding Dr. Park’s case was sent to Attorney Zhang. Attorney Zhang called USCIS and confirmed this approval.

    08:43AM: Attorney Zhang informed Dr. Park the good news. In the email, Attorney Zhang wrote that:
    “I am pleased to inform you the e-mail approval notice from USCIS for your EB-1(a) case. It was approved on the same day that USCIS received the documents.
    I would like to thank you for your trust and co-operation. Moreover, I would like to thank my team members, Nosheen, Jeannette, Huamei and Hongmin for their excellent work. Furthermore, I appreciate Dr. Gupta’s recommendation.”

    Dr. Park was very glad to see such a quick approval. In the reply, he wrote that: “Thank you all for this great job which has been done by your team. As I said in yesterday’s email, it was a big surprise to me for the petition letter regarding the evacuation system for sky-rise buildings. Thank Attorney Liu very much for this excellent drafting.
    It is my pleasure to recommend my friends. I believe that all my colleague will know your firm very soon, probably in the lunch time today. Again, thank you all very much!”

    Dr. Gupta, who referred Dr. Park to our firm, was also very happy to see the quick approval of Dr. Park’s case. He wrote another enthusiastic email to Attorney Zhang:
