We helped a Korean virologist receive CIS EB2NIW Approval in 3 months without RFE!
Since the release of the U.S. Department of State’s November 2012 Visa Bulletin last month, it has been a well known fact, that the EB-2 category for all applicable countries except China and India is once again “current”. This means that, as of November 1, 2012, DOS has completely removed cutoff dates for individuals who qualify for the EB-2 category, and that these individuals can file the I-485 Adjustment of Status Application (green card application) concurrently with the I-140 Petition for Alien Worker. This has been also very good news for Korean-born applicants to file a green card application immediately under the category of EB-2 NIW.
Recently, we helped a Korean postdoctoral researcher receive the CIS approval notice of his EB2NIW petition in 3 months. His I-140 EB2NIW application was filed on June 27, 2012 and approved on September 26, 2012 without a Request for Evidence (RFE).
This applicant received a Ph.D. in Veterinary Virology from a U.S. university in 2007. As a molecular virologist, he is currently playing a critical role in the NIH-funded projects, conducting leading-edge studies in the important area of swine and mosquito-borne zoonotic viral disease research. Throughout his past and current research, he has made original scientific research contributions to the understanding of the virus-host cell interaction of emerging alphaviruses. His research work is of high importance to the national interest of the United States, in the area of public health care. His research on swine virus, zoonotic mosquito borne alphaviruses, and insect-specific flavivirus has practical significance in combating highly devastating and dangerous human and animal viral disease and has a direct link to the U.S. long-term interest in public health care.
To establish that the degree of benefits and impact demonstrated by the applicant’s research is greater than most of his peers in the field, we thoroughly documented his research achievements, including 5 first-author papers, 2 co-author papers, 14 conference presentations, more than 80 research citations, and 10 review citations, among other documents. In addition, we made much effort to carefully and thoroughly draft seven (7) expert opinion letters based on his personal statement and other information provided. These drafts were later improved and refined with the additions made by the applicant based on our careful advice and suggestions.
Particularly, the merits of his case are exceptional in view of the practical significance of his research for the U.S public health interest. His swine and mosquito-transmitted zoonotic viral disease research have been both supported by grants from the United States Department of Agriculture (USDA) and the National Institutes of Health (NIH). The significance of his research findings is that they are helping to protect public health against highly pathogenic emerging alphaviruses. His seminal work has significant impact both nationally and internationally, on prevention and control of several nefarious viruses of animals and humans. His novel studies on vaccine development of zoonotic alphaviruses are a matter of primary importance to people’s public health across the nation.
