이미 언론매체 보도나 인터넷 정보등을 통하여 대부분 알고 계실 내용이지만, USCIS는 12월 23일부터 인상된 접수비를 받게 됩니다.

변호사를 통하여 접수를 하시는 분들은 별 문제 없으실 것으로 생각이 되지만, 혹시라도 직접 접수를 하시거나 Fee 인상에 대해서 확인하지 않으셔서 불이익을 받으시는 일이 없으시기를 바라는 마음으로 칼럼에 정리를 해 드립니다.

2016년 12월 23일부터 USCIS는 대부분의 application/petition들의 filing fee를 인상하였기 때문에 12월 23일, 그리고 그 이후에 접수하시는 혹은 메일로 보내시는 경우는 인상된 금액으로 보내셔야 합니다. (“Applications or petitions mailed, postmarked, or otherwise filed on or after December 23, 2016 must include the new fee”.)

12월 23일 이후에 반드시 접수를 해야 하는 서류라면 인상된 금액을 반드시 보내셔야 Reject 당하시는 것을 피하실 수 있으며, 12월 23일 이전에 접수가 가능하신 서류라면 (예를 들어 시민권 신청이나 영주권 갱신 등 비교적 간단한 서류들을 포함하여) 가능한 한 12월 23일 이전에 접수하셔서 비용을 절감하실 수 있기를 바랍니다.

12월23일전에 신청가능한가요?

2016년 11월부터 신청이 가능하십니다. 온라인으로 신청하면 대충 삼십분이면 모두 선청/결제 모든 처리가 가능합니다.

지금 그래서 시민권 신청을 온라인으로 접수를 하고 싶은데 온라인으로 접수하는 방법을 모르겠어요.

온라인으로 신청하신 분들은 어떻게 하셨나요?

온라인은 안되는 걸로 알고 있는데요.
온라인으로 하라는 곳은 진짜 USCIS가 아니예요…

저도 김민수님의 게시글을 보고 온라인으로 지난주에 시민권 신청해서 680불 내었다는 영수증을 우편으로 받았습니다.

현재 140 과 485 동시 접수를 준비하고 있습니다. 23일부터 인상이라면 22일까지는 서류가 도착을 하여야 하는데.. 말씀하신 접수일이 우체국 소인이 찍힌 기준인지 아니면 도착하는 날짜 기준인지 궁금합니다.

Moonki님; 변호사님이 쓰신 글에 postmarked라고 써 있어요. 날짜 소인찍히면 될텐데
그래도 너무 불안하게 보내지 마시고 빨리 도착하게 보내시는 게 안전할 듯 보이네요..

수수료 오르기 전에 시민권자 배우자로 영주권 신청을 하려고 하는데 다른 서류는 다 준비가 되었는데 Medical exam/vaccination 서류 때문에 petition을 못보내고 있습니다. 피검사한 거 lab result가 22일에야 나온답니다ㅠㅠ 22일 오전중에 doctor’s office에서 연락오면 가서 서류 픽업해서 바로 UPS나 FedEx로 보낼껀데 크리스마스 연휴 이후에 USCIS에 도착하더라도 보낸 날짜만 22일이면 괜찮은가요? 수수료 오르는 소식을 너무 늦게 알게된게 아쉽네요… 정확히 쫌 clarify해주셨음 합니다.

“Postmarked”의 의미는 우체국에서 마지막 픽업을 하기 전에 우체국 소인을 찍어야 한다는 말을 의미합니다.
하지만 지금까지 새로운 fee를 적용하는데 있어서, USCIS는 많은 경우에 다양한 이유로 언제 “received”하였는지를 기준으로 삼아 처리한 경우가 많았으므로, 가능하면 22일까지 “도착”하는 것이 안전합니다.

저도 위에 “변호사님”과 비슷한 상황인데, usps 로 보내서 usps tracking상으로는 12/21일날 도착했다고 되어있는데 아직까지 체크가 은행에서 안빠져 나갔네요. 돈빠져나간날 기준인지 usps 도착날짜 기준인지도 알려주시명 감사하겠습니다 ㅠㅠ

Fedex나 UPS같은 courier service도 postmark로 간주 될 것인가에 대해 변호사들도 서로 이견이 있었습니다. 그 이유는 과거에 courier service는 postmark로 간주하지 않았던 적이 있었기 때문인데요.
AILA에서 어제 이 문제에 관하여 USCIS와 confirm하였습니다.
“22일 혹은 그 이전에 postmark된 모든 신청서는 언제 도착하였는지에 상관없이 기존의 fee를 받습니다. 또한 Fedex나 UPS같은 courier service의 receipt notice도 postmark로 간주되어 fee 적용을 받게 됩니다.”
