화학물리학 분야 연구원의 NIW 사례

최근 저희는 화학물리학(chemical physics) 분야의 연구원이 NIW승인을 받을 수 있도록 도와드렸습니다.

신청인은 물리학 석사와 박사학위를 취득하였으며, 현재 미국 내 주요 연구 대학 중 한 곳에서 Associate Specialist로 연구활동을 하고 있습니다. 그의 연구는 고해상도 광이온화(high-resolution photoionization), 광전자 분광학 (photoelectron spectroscopy), 행성의 대기화학 및 우주공간 환경에 관련된 이온-분자간 반응역학(ion-molecule reaction dynamics)을 전문화하였습니다.

EB2NIW서류를 접수하기에 앞서 신청인은 연구실적에 관련하여 다음과 같은 증거서류를 준비하였습니다: 1) peer-reviewed 저널에 게재된 논문 15편; 2) 학회발표 2건; 3) 타 논문에 의해 인용된 횟수(피인용)(independent citations) 27회 & 자기인용(self-citation) 38회; 4) 동료평가(peer-review)기록 3회; 5) 전문가 소견서/추천서 5부(4 independent expert opinion letters & 1 supervisor opinion letter). 추천서에 있어서는, 신청인은 letter samples/templates를 사용하여 current supervisor opinion letter & independent expert opinion letter 초안 2부를 준비하였습니다. 그 후에 본인의 NIW 준비과정을 더 신속하게 하기 위해서 저희에게 ‘Letter Drafting Service’를 요청하였으며, 신청인의 personal statement와 그외 필요한 supporting information에 근거하여 independent expert opinion letter 초안 3부를 작성하였습니다.

신청자의 독창적인 연구 기여의 정도를 평가할 때, 담당 이민관은 신청자의 연구결과에 대한 인용횟수를 보여주는 인용 증거 서류를 심사합니다. 일반적으로 피인용 횟수는 신청자의 전문분야에 미치는 연구 기여에 대한 영향력 범위/정도를 나타냅니다. 본 예시된 케이스에서는, 신청인의 게재된 논문 수에 비추어 보아 신청인의 피인용 횟수가 충분하지 않은 관계로, 다른 연구자들이 어떻게 신청인의 연구결과에 의존하였는지 또는 그의 연구결과가 연구분야에 어떻게 영향력을 미치었는지 기술하는 것에 주의를 기울였습니다.

저희와 신청인 사이의 추천서 초안 수정/보완 작업 과정을 통하여, 신청인은 본인의 연구결과가 관련된 분야의 다른 연구자들에 의하여 어떻게 사용 또는 인용/참고되었는지 자세하게 기술하였으며, 본인의 연구(결과)를 인용한 주요 과학자들을 예시하거나 어떻게 그들의 연구활동이 자신의 연구결과에 영향을 받았는지 기술하였습니다. 전문가 소견서/추천서와 인용 증거 서류를 통하여, 신청인은 다른 연구자들이 자신의 연구결과의 가치와 화학 물리학 분야에서의 실제적인 중요성을 인정하였다는 점을 논증하였습니다.

신청인의 EB2NIW서류는 이민국(USCIS NSC)에 접수된 후 RFE없이 3개월 14일만에 승인되었습니다.
