We helped a Neuroscientist with 4 papers receive CIS Approval of EB2NIW Petition without RFE.
Lately, we helped a neuroscientist who had only 4 published papers obtain an approval of his NIW petition. His I-140 EB2NIW application was approved on April 11, 2013 without a Request for Evidence (RFE).
The client (case number: S-1457) received a Ph.D. degree in Development Biology from a foreign country. He currently works as a Postdoctoral Fellow at a US university.
In order to help this client who had a very limited number of publications, we made strong legal arguments that she has performed cutting edge research studies on the pathogenesis of Parkinson’s disease for the past 5 years. Through expert opinion letters and documentation of his research achievements, we have successfully showed that his past and current research specializing on the molecular mechanism of Parkinson’s disease is within the areas of national interests such as improved healthcare of the United States by providing new treatment strategy of PD disease.
We also help the client submit objective evidence to prove that he has made original research contributions to molecular genetics by implementing a novel method of visualizing mitochondrial morphology and examining the metabolic function of mitochondria on physiological condition. His research work concentrated on the research for mitochondrial role during development and disease condition such as Parkinson’s disease (PD). PD is the second most common neuro-degenerative diseases, which is more than a scientific issue. The US National Institute for Neurological Disorders and Stroke (NINDS) estimated that the economic cost of Parkinson’s disease in the US exceeds $10 billion per year. The client’s research studies have been providing new basic and clinical insights into stem cell biology and hold promise for developing applications to neurodegenerative disorders, including Parkinson’s disease and Alzheimer’s disease, as well as cancer. His research career is set on a stellar course that is bound to have a long-term impact on the neurological health of all Americans.
To establish our client’s uniqueness and innovativeness to serve the national interests, we argued that his current position and ongoing projects supported by the National Institutes of Health (NIH) rely on his previous research findings and expertise in his field of specialty as well as his intellectual power and experience in stem cell biology and mitochondrial dynamics to continue the ongoing research projects.
We helped the client establish that his research achievements have some degree of impact/influence on the field as a whole, by documenting his 3 first-authored paper, 1 co-authored papers, research citations, 2 major media reports, and 5 opinion letters among other documents.
The success of the client’s EB2NIW petition without a RFE proves that if the attorney prepared the client’s case well, it can be approved by the CIS even the client has a very limited number of publications.
We have also helped a number of clients who are outside of the United States win green card application because the EB2NIW applicants who are outside the United States (e.g. in Korea) do not need a U.S. employer to sponsor a green card application. But the applicant needs to have a U.S. institute provide a ‘Letter of Intent to Offer’ to USCIS to prove that he/she will be offered a research position in his/her field of specialty in the United States after obtaining a green card.
