File a green card application in EB1A category to avoid a long visa backlog. We helped a Postdoctoral Research Associate receive CIS Approval of EB1A Petition in 2 months and 19 days.
Recently, the U.S. Department of State announced through its Visa Bulletin the availability of immigrant numbers for each employment-based preference category during July 2012. Continued heavy demand for numbers in the employment-based second preference immigrant visa category (EB2 including EB2NIW) has resulted in the establishment of a worldwide cut-off date for the month of July.
For those born in India and Mainland China, this category has been completely “unavailable” prior to September 30, 2012. For those born in Korea, Hong Kong, Taiwanese, and other applicable countries, priority date cut-offs have been established by the DOS, and there is a long visa backlog to file an application for Adjustment of Status (I-485). Many EB2NIW applicants born in the above-listed countries, who are Ph.D. students and postdoctoral researchers, are frustrated by the current situation, as they have become so-called “visa-backlog-subject-applicants” with such action taken by the DOS.
However, if you are subject to this visa backlog and qualified for EB1A, we suggest that you apply for a green card in EB1A category. The employment-based first preference categories are “current” (i.e., visa numbers are available for all qualified applicants) worldwide.
An EB1A is an immigrant visa in the EB1 category that is reserved for foreign workers of extraordinary ability in the sciences, arts, education, business or athletics.
The qualifications of an EB1A applicant include the following:
a) Lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavor;
b) Documentation of the alien’s membership in associations in the field for which classification is sought, which require outstanding achievements of their members, as judged by recognized national or international experts in their disciplines or fields;
c) Published material about the alien in professional or major trade publications or other major media, relating to the alien’s work in the field for which classification is sought. Such evidence shall include the title, date, and author of the material, and any necessary translation;
d) Evidence of the alien’s participation, either individually or on a panel, as a judge of the work of others in the same or an allied field of specification for which classification is sought;
e) Evidence of the alien’s original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field;
f) Evidence of the alien’s authorship of scholarly articles in the field, in professional or major trade publications or other major media;
g) Evidence of the display of the alien’s work in the field at artistic exhibitions or showcases; and
h) Evidence that the alien has performed in a leading or critical role for organizations or establishments that have a distinguished reputation.
Synopsis of Our Successful EB1A Case
Recently, we helped one of our EB1A clients obtain an approval of his EB1A green card petition in 2 months and 19 days. His I-140 EB1A application was filed on February 7, 2012 and approved on April 26, 2012.
The client received a Ph.D. degree in Biochemistry and Proteomics in Hong Kong, and is currently a postdoctoral research associate at one of the prestigious universities in the U.S., working in the field of cardiovascular proteomics research.
