(12-14) 15:35 PST — A 42-year-old Chinese immigrant living in Cupertino has been charged with stealing trade secrets from a Silicon Valley defense contractor and trying to sell them to military buyers in Thailand, Malaysia and the People’s Republic of China.

The indictment against Xiaodong Sheldon Meng, 42, was announced today by U.S. Attorney Kevin V. Ryan, who said it was the third criminal prosecution issued since the passage of the 10-year-old Economic Espionage Act of 1996.

Ryan, U.S. Attorney for the Northern District of California, said in a statement that Meng was initially charged on Dec. 9 and is currently free on $500,000 bail. He is scheduled to appear Monday before U.S. Magistrate Judge Howard Lloyd in San Jose.

It was not immediately possible to contact Meng or his attorney.

The 36-count indictment covers six separate areas of law, including two violations of the Arms Export Control Act, that are alleged to have occurred after June 2000 when Meng was hired as a systems engineer by Quantum 3D. Ryan’s office said the San Jose firm is cooperating in the investigation.

If convicted, Meng could face prison and fines.
