A Korean virologist in the field of HIV pathogenesis received CIS EB2NIW Approval in 5 months without RFE!

Our law firm has recently succeeded in helping a Korean research scientist apply for a green card in the EB2NIW classification and get her petition approved in 5 months.

The client is a postdoctoral researcher working for the research projects to conduct pioneering research on the development of novel HIV therapeutics at a U.S. university, one of the best medical schools in the nation.   She has a Ph.D. degree in Microbiology.  We helped her prepare and file documents under the immigration classification of EB2NIW.

The client’s research is focused on elucidating pathogenesis of HIV and developing anti-HIV therapeutics utilizing gene therapy and high throughput screening (HTS).  We have argued that the applicant has made impressive research contributions to the molecular biology and pathogenesis of human immunodeficiency virus (HIV) which directly address a health issue in the United States, and are practically significant to the development of efficient anti-HIV therapeutics.  Her current efforts to identify drugs targeting virus release will contribute to improve current anti-retroviral treatment (ART) that would bring more efficient HIV efficacy and slower appearance of drug resistant viruses in combination with other classes of drugs.

The client’s research projects have been directly linked to the health care of the United States, and funded by the National Institutes of Health (NIH) as well as California HIV/AIDS Research Program (CHRP).  1.7 million people in the U.S. are estimated to have been infected with HIV, including over 619,000 who have already died and approximately 1.2 million (1,178,350) adults and adolescents who were living with HIV infection at the end of 2008.  The applicant has made several important and innovative research contributions, in particular in the area of discovery of molecular mechanisms of how cells protect themselves from HIV, and how this deadly human virus over-rides those efforts, leading to disease anti-HIV cellular restriction factor and viral counteractions.  Her research work and discoveries have practical significance to an important national interest of the United States, by improving how we treat deadly viral diseases, and thereby improving quality of life, which is clearly an area of substantial importance to this country.

The client has published 7 scholarly papers in highly esteemed professional journals, such as Retrovirology, Journal of Virology, Virology Journal, etc. and provided 19 presentations at national and international conferences.   We have thoroughly documented her supporting evidence, including copies of journal publications, conference presentations, citations of her papers, awards/honors, etc.  Additionally, we carefully and thoroughly drafted seven (7) expert opinion letters for the client.

After our meticulous preparation of her EB2NIW documents, we filed her applications to CIS Nebraska Service Center.  The EB2NIW application prepared and filed by our law firm on January 10, 2013 was approved by the CIS Nebraska Service Center on June 11, 2013 without RFE.

We have also helped a number of clients who are outside of the United States win green card application because the EB2NIW applicants who are outside the United States (e.g. in Korea) do not need a U.S. employer to sponsor a green card application.   But the applicant needs to have a U.S. institute provide a ‘Letter of Intent to Offer’ to USCIS to prove that he/she will be offered a research position in his/her field of specialty in the United States after obtaining a green card.

Our law firm has substantial experience for more than 18 years to help postdoctoral researchers, professors, engineers, and other advanced degree professionals apply for nonimmigrant status in O1, H1B, etc., and green card applications in EB1A, EB1B and EB2NIW.  For more information, you can visit our website at http://www.sunlawfirm.us/KoreanPage.htm.

We provide Free Evaluation services. If you are interested in a Green Card application, please email us your resume, the number of citations of your works, and your main contributions to alicesunlaw@gmail.com. Subject: Green Card Application.
